Cookin’ Around the World, LLC
Participant Waiver, Release of Liability, Assumption of Risk, and Media Release
By registering for, attending, participating in, observing, volunteering for, or otherwise engaging in any program, class, camp, workshop, event, field trip, gardening activity, cooking activity, private lesson, catering demonstration, enrichment program, or related activity offered by Cookin’ Around the World, LLC (“CATW”), participants and, where applicable, parents and legal guardians acknowledge and agree to the following:
Assumption of Risk
Participation in cooking, gardening, educational, recreational, and cultural enrichment activities involves inherent risks that cannot be completely eliminated regardless of the care taken to avoid injuries.
These risks may include, but are not limited to:
* Cuts, punctures, lacerations, scrapes, and abrasions
* Burns from ovens, hot surfaces, hot liquids, steam, cooking equipment, or food preparation activities
* Slips, trips, falls, and other accidental injuries
* Allergic reactions to food ingredients, plants, environmental conditions, or other substances
* Foodborne illness or illness related to food preparation, handling, consumption, or transportation
* Injuries resulting from the use of kitchen equipment, utensils, tools, appliances, gardening tools, or related materials
* Injuries caused by the actions or negligence of other participants
* Exposure to communicable illnesses
* Property loss, theft, or damage
* Any other injury, illness, accident, or unforeseen circumstance arising from participation
Participants and their parents or legal guardians voluntarily assume all risks associated with participation in Cookin’ Around the World activities.
Health, Dietary Restrictions, and Allergies
Participants and parents/guardians are solely responsible for determining whether participation is appropriate based on the participant’s health, physical condition, dietary restrictions, allergies, or medical needs.
Cookin’ Around the World strives to promote food safety and allergy awareness; however, CATW cannot guarantee an allergen-free environment. Ingredients may be processed, manufactured, transported, or stored in facilities that handle common allergens including, but not limited to, dairy, eggs, wheat, soy, sesame, fish, shellfish, peanuts, and tree nuts.
Participation is undertaken at the participant’s own risk.
Release and Waiver of Liability
To the fullest extent permitted by law, participants and, where applicable, parents and legal guardians release, waive, discharge, and hold harmless Cookin’ Around the World, LLC, its owners, officers, directors, employees, instructors, contractors, volunteers, agents, affiliates, sponsors, facility partners, landlords, and representatives from any and all claims, demands, actions, damages, liabilities, losses, expenses, costs, attorney’s fees, or causes of action arising out of or related to participation in any Cookin’ Around the World activity.
This release includes, but is not limited to, claims arising from:
* Personal injury
* Illness
* Foodborne illness
* Allergic reactions
* Burns
* Cuts
* Falls
* Property damage
* Emotional distress
* Medical expenses
* Loss of income
* Death
except where such claims are caused by gross negligence, willful misconduct, or where prohibited by applicable law.
Emergency Medical Care
In the event of a medical emergency, Cookin’ Around the World staff may seek emergency medical treatment when deemed necessary. Participants and parents/guardians acknowledge that all costs associated with medical treatment, transportation, hospitalization, or related services remain the sole responsibility of the participant or participant’s parent/guardian.
Participant Conduct and Removal
Cookin’ Around the World reserves the right to deny participation, remove, suspend, or dismiss any participant whose behavior is disruptive, unsafe, threatening, abusive, or otherwise detrimental to the safety, wellbeing, or educational experience of others.
No refunds are guaranteed when removal is necessary due to participant misconduct.
Photography, Video, and Media Release
Unless prohibited by law or expressly opted out through a separate written agreement accepted by Cookin’ Around the World, participants and parents/guardians grant Cookin’ Around the World permission to photograph, record, videotape, interview, and otherwise capture participant likenesses, voices, artwork, recipes, projects, and activities.
These materials may be used without compensation for:
* Marketing and advertising
* Social media
* Websites
* Newsletters
* Printed materials
* Educational content
* Grant applications
* Public relations and promotional purposes
Cookin’ Around the World retains all rights to such media.
Indemnification
Participants and parents/guardians agree to indemnify, defend, and hold harmless Cookin’ Around the World, LLC and its representatives from any claims, liabilities, damages, losses, expenses, or costs arising from the participant’s actions, conduct, negligence, or violation of program rules.
Governing Law
This Agreement shall be governed by and interpreted under the laws of the State in which the Cookin’ Around the World program or event is conducted, without regard to conflict of law principles.
Agreement and Acceptance
By registering for, purchasing, enrolling in, attending, participating in, observing, volunteering for, or otherwise engaging in any Cookin’ Around the World activity, participants and parents/legal guardians acknowledge that they have read, understood, and voluntarily agree to be bound by the terms of this Waiver, Release of Liability, Assumption of Risk, and Media Release Agreement.
Participation in any Cookin’ Around the World program constitutes acceptance of these terms and conditions.
